互联网正步入算法驱动的商业大数据时代,但算法歧视问题层出不穷,尤以电子商务领域的大数据杀熟、粉红税等前端科技热点最为突出,引发广泛关注。相较于国际,国内算法治理研究明显滞后,面临着法律体系不健全、司法保护薄弱等瓶颈问题。为应对挑战,需结合算法技术特征,借鉴美国、欧盟等治理经验,从算法设计者与消费者两方面入手。算法设计者应完善备案制度,严格限定初始数据集规模与质量标准,确保算法透明公正;而针对消费者应建立健全第三方算法解释机制,保障其知情权与救济权,使算法决策透明可追溯,促进算法应用健康发展。The Internet is entering an era of algorithm-driven big data commerce, yet issues of algorithm discrimination are emerging endlessly. In particular, front-end technological hotspots such as price discrimination against loyal customers (big data “killing” familiar customers) and the “pink tax” in the field of e-commerce have stood out prominently, attracting widespread attention. Compared to international efforts, research on algorithm governance in China is notably lagging behind, facing bottlenecks such as an incomplete legal system and weak judicial protection. To address these challenges, it is necessary to consider the technical characteristics of algorithms and draw on governance experiences from the United States, the European Union, and other regions, approaching the issue from both the perspectives of algorithm designers and consumers. Algorithm designers should improve the registration system, strictly limit the size and quality standards of initial datasets to ensure transparency and fairness in algorithms. For consumers, a comprehensive third-party algorithm explanation mechanism should be established to protect their rights to information and remedy, making algorithmic decisions transparent and traceable, thereby promoting the healthy development of algorithm applications.
